It's more about satisfying the bullet points process laid out in the Law of War. Even if the UN rejects our demands, it is not legally permissible to immediacy invoke military tribunals without having first having satisfied these steps.
This said, that's just my read on that one step. I'm not sure what the Q team plans to do with it, but if they petition, the above is why I think that could happen.
