This document also contained a very ominous "get vaccinated" message towards the bottom, and my employer wanted me to sign the notice. I refused. When I came into work, I immediately received a random drug test referral. This will be my 5th this year. I have been outspoken about my wishes for medical privacy at work, so I suppose some form of retaliation was somewhat expected. The problem is that no one that I work with has had more than one random drug test this year. Can I request information about this application they use to "randomly" choose employees?
Probably not. My husband used to get a lot more random checks than his peers. We always thought it was because they knew he would always test negative so that they wouldn’t have to worry about doing anything.

What type of test? Piss test? Blood test? Stick something up your nose test?
Assuming it is a standard piss test for mood-altering drugs, and assuming you have done this test 4 times before, and assuming you passed each time, and assuming you know you will pass this time, I would assume it is an attempt to get you to refuse and find a way to get rid of you for refusing a test you previously agreed to do.
In that case, my inclination would be to write an email to document, document, document! for future use. I would say something like:
"I have been informed that I have been randomly chosen for a drug test, for the 5th time this year. I will be happy to take the test, as I am confident I will pass it like have have done every other time. I would also like for you to explain to me why I have been chosen "randomly" 5 times when no other employee has been "randomly" chosen more than 1 time. I would like to know if this is retaliation for my non-response to your request (or demand) that I take a vaccine for which I have not previously agreed. Let me know when the drug test is schedule. Thank you."
IOW: Agree to the test, so they don't have a legal basis to get rid of you. At the same time, call them out on the fake randomness, but do not make it a condition of taking the test (which could be viewed as refusal). Call them out on it so you (a) document this is what has been happening (for future lawsuit if needed), but (b) be nice about it and don't expect them to respond (which is actually good, if you have a future lawsuit -- shows lack of good faith on their part). Also, call them out on the possibility that they are retaliating against you. You have NO PROOF, so don't accuse. Just ask the question. A question is not an accusation. But they are still on notice that you are not dumb enough to not notice. Also, make it clear (documenting, again) that you have NOT previously agreed to this new condition regarding a "vaccine" (i.e. experimental drug). But no need to get into the details of that now, because this is just about the routine drug test (I assume).
Puts you in a position of agreeing to the "random" test, while also putting them on notice that you are wise to their fuckery, but being nice and cooperative about it all, which means they have no legal basis to take action against you, but sets you up by documenting things so you might have a legal case against them in the future.
That's how I see it, anyway.
I used to get the random drug test in the military! One time I smoked a live wire and the next morning I was told to report for a drug test! I called the wife and had her bring me a bottle of vinegar and a couple of Gold Seal Root capsules. I guzzled the vinegar and did the Gold Seal Root and tested negative. This was the last time I did any drugs in the military and haven't missed any of the old vices. The LORD keeps me high everyday with the WORD and my service is to HIM! The good news I Retired from the Military 27 years ago!
Well, you could request the information but I doubt you'll get it. You will however probably get another "random" drug test.
Make sure and schedule it during work hours 👍🏻 They pay you for it right? Take a small lunch break too.
Just don’t let them know they are getting to you…it’s complete BS what they are doing, but you start to push back on even legal policies they’ve had in place for a long time, you will not be employed very long. Stick to refusing the covid stuff…or not, your job and your call.
