Lewis Voting Rights Advancement Act of 20201, also known as H.R. 4, Breitbart News reported.They were hoping you weren’t paying attention.The bill passed along party lines, 219-212, with Democrats (obviously) strongly in favor of the act, and Republicans in opposition.The bill, named after the late congressman Rep. John Lewis (D-GA), a prominent civil rights activist, should more have aptly been called the “Elect Democrats in Perpetuity Act.”The legislation, in clear violation of Article II, Section I, Clause II of the United States Constitution would remove control over elections from the states, where that article places them and instead put elections under the control of Washington, D.C., bureaucrats.Under the law, the legislation mandates that any state or its political subdivisions (read counties, cities and towns) would have to obtain preclearance from either the (politically charged) Department of Justice (DOJ) or the U.S. District Court for the District of Columbia prior to making any changes which might affect “voting rights"Under the measure, a state and its political subdivision would be subject to preclearance for a ten-year period under the following circumstances:15 or more voting rights violations occurred in the state during the previous 25 years; 10 o4 more violations occurred during the previous 25 years, at least one of which was committed by the state itself; or Three or more violations occurred during the previous 25 years, and the state administers the elections; A political subdivision as a separate unit shall also be subject to preclearance for a 10-year period if three or more voting rights violations occurred there during the previous 25 years. In addition, states must notify the public of changes to voting practices (already done). The measure also mandates that courts must take under consideration the history of voting discrimination in the state or political subdivision.However the measure is chock full of holes, probably deliberately. For example, as Breitbart notes the above triggering events do not necessarily have to be bona fide violations of voting rights.Thusly, if leftist groups were to file lawsuits against Democrat-controlled cities for typical election integrity safeguards and the city were to admit fault and settle the matter, rather than defending it in court, which would in fact count toward the tally which would trigger preclearance requirements for the entire state.In other words, Democrats could game the system.Not surprisingly, House Republicans eviscerated the legislation.One such Republican was Rep. Byron Donalds (R-FL) who warned Americans not to be fooled by the legislation in the following tweet:Rep. Debbie Lesko (R-AZ) said, “H.R. 4 gives the Biden DOJ authority to designate a voter ID law as a voting rights violation or as evidence of voting discrimination. H.R. 4 is an unconstitutional way for the federal government to dictate elections and a way to weaken the vote of the American people!”Rep Drew Ferguson (R-GA) said:“#HR4 is nothing more than another Pelosi power play to federalize our elections. This unconstitutional attack hampers states’ ability to conduct free and fair elections, eliminates commonsense voter ID requirements, and gives DC bureaucrats veto authority. I’m voting NO,” Ferguson, the Republican chief deputy whip said.Within days after Biden’s inauguration, House Democrats introduced HR 1 and Senate Democrats intr0duced S 1, both designed to further destroy America’s electoral system. PROMOTING ABILITY OF VOTERS TO VOTE BY MAIL(a) Uniform Availability of Absentee Voting to All Voters—(1) IN GENERAL- If an individual in a State is eligible to cast a vote in an election for Federal office, the State may not impose any additional conditions or requirements on the eligibility of the individual to cast the vote in such election by absentee ballot by mail.(2) ADMINISTRATION OF VOTING BY MAIL—(A) PROHIBITING IDENTIFICATION REQUIREMENT AS CONDITION OF OBTAINING BALLOT—A State may not require an individual to provide any form of identification as a condition of obtaining an absentee ballot, except that nothing in this paragraph may be construed to prevent a State from requiring a signature of the individual or similar affirmation as a condition of obtaining an absentee ballot.(B) PROHIBITING REQUIREMENT TO PROVIDE NOTARIZATION OR WITNESS SIGNATURE AS CONDITION OF OBTAINING OR CASTING BALLOT.—A state may not require notarization or witness signature or other formal authentication (other than voter attestation) as a condition of obtaining or casting an absentee ballot.(3) PERMITTING VOTERS TO DESIGNATE OTHER PERSON TO RETURN BALLOT.—The State—(A) Shall permit a voter to designate any person to return a voted and sealed absentee ballot to the post office, a ballot drop-off location, tribally designated building, or election office so long as the person designated to return the ballot does not receive any form of compensation based on the number of ballots that the person has returned and no individual, group, or organization provides compensation on this basis; and(B) May not put any limit on how many voted and sealed absentee ballots any designated person can return to the post office, a ballot drop off location, tribally designated building, or election office.Banning Voter ID(1) IN GENERAL.—Except as provided in subsection (C), if a State has in effect a requirement that an individual present identification as a condition of receiving and casting a ballot in an election for Federal office, the State shall permit the individual to meet the requirement—(A) in the case of an individual who desires to vote in person, by presenting the appropriate State or local election official with a sworn written statement, signed by the individual under penalty of perjury, is attesting to the individual’s identity and attesting that the individual is eligible to vote in the election;Other provisions in the legislative proposal? It would explore statehood for the District of Columbia (clearly unconstitutional), would look into extending voting rights to United States territories such as Puerto Rico and Guam, would establish complete Congressional takeover of redistricting.Probably one of the most damning and frankly tyrannical proposal is found in Sec. 3201 of the Bill, NATIONAL STRATEGY TO PROTECT UNITED STATES DEMOCRATIC INSTITUTIONS.Sounds noble, right?
