I have been trying to make this precise point, that the SOLE purpose of the SCOTUS in this matter is deciding on the legality / constitutionality of the OSHA mandate, and that all other subsidiary parts in the argument (safety, setting policy, etc.) are irrelevant. Sadly, some people don't want to hear that, their fear is ratcheted up so high that they will accept any authoritarian to "save them."
