"The will of the people" is reflected in the way they vote (ideally you cheating bastards). The constitutionality is determined by the supreme court.

If this is a problem, it's revolution enacting.....and if they think the people wish to battle themselves or the military, they are wrong. If they think they will not, they are more wrong.
