My company has a "vax or test policy" and my line of work is considered "essential", but I'm in a weird working from home grey area. I refused to submit myself to weekly testing and be treated like a 2nd class citizen, because there is (obviously) no way I'm getting the deathjab.
From my research on u/20-guage's info, "vax or test" has no legal basis anymore than "vax or fired" does. Just think about it: it's complete medical discrimination to treat people differently based on their health status. The "Covid and Coffee" lawyer talks about this a bit on one of his blog's (from 20-guage links). The problem comes into play as "vax or test" is a "reasonable accommodation" according to my company. "Don't want the vax? Just prove to us you're not a medical risk to other employees by being treated differently!"
I have faith this can be fought, legally, but I'd like to get in touch with a lawyer and get some hard confirmation. Unfortunately, I've tried contacting Renz Law over 4 weeks ago and I haven't received a response from them. I think I'll try Barnes Law next and see if I can get a response there.
I've committed myself to being fired from my job and HR proceedings have already started against me. I believe they're giving me 3 strikes before I'm out and I'm on strike #2.
Not sure any of this helps. I guess my only advice would be to try going the religious exemption route and pray it gets you out of hot water at your company. Or buys you time.... hopefully class actions will get started sooner than later.
