A 4-4 split favoring the Left for appeals making it to SCOTUS, lets the prior decision stand. Their way of stacking the courts for cases in the pipeline perhaps? The Trump Trio have been constitutional duds, so a 4-4 is plausable
Remember, we're not gaining a lib. The court would actually be down a lib during such time for less liberal advantage than they have now.
Roberts & the Trump trio cannot be completely considered in the bag. A 4:4 split was being optimistic.
True. Though we don't need Roberts, the Trump appointees have yet to prove out and have made a few rulings that conservatives don't really like.
