If this is true, then it is obvious this is a strategic ploy for the mid terms by the Dems to motivate more Democrat voters.
Scenario A: They nominate someone reasonable enough to get the 60 senate votes to confirm, and the Dems look strong(er) for November having accomplished securing their liberal justice vote in SCOTUS.
Scenario B: They nominate a black woman, which in itself is not the problem with the nominee, but she is an absolute whackadoodle moonbat, which prevents her from getting the 60 votes. Her appointment gets blocked by the GOP, and the Dems will cry white supremacy, racism, and misogyny from the “evil GOP”.
IMO, scenario B makes more sense, since it will garner more motivation for the Dems, AND they are in no hurry to actually replace him immediately because they can simply ask Breyer to extend his stay on the court, especially since he wasn’t quite ready to retire anyway.
Anyway, just be ready for whatever they are up to. Whatever comes of this, we know they are up to something.
EDIT: simple majority is needed in the senate to confirm, not 60.
Scenario C: with an even split of 11/11 of the senate judiciary, black liberal woman would pass cloture with a simple majority, making her eligible for confirmation with also a simple majority.
Assuming a party line vote, Kamala would break the tie.
