So, I think the Durham investigation and the Trump vs. Clinton-RICO lawsuit will go along in a leap frog type of strategy. Even though Trump is not aligned with Durham and his investigation, when Durham releases info to the public, then Trump lawyers acts on his behalf working off of their own discovery AND what Durham has released.
Remember;
Durham investigation is a criminal case that will end up being a RICO criminal case (if it isn't established already). This may lead to the Treason, Sedition, subversion criminal case as well, which may then be turned over to the military for tribunals.
Trump lawsuit is a civil case alleging the defendants in a RICO conspiracy. Then he may be able to file a separate lawsuit for criminal charges against him personally of the said defendants.

This Trump vs. Clinton lawsuit sets a precedence for 'pattern behavior' and Trump will most likely file lawsuits against Biden, Harris, Biden Campaign, Harris Campaign, DNC, Perkins, Coie, Elias, Sussmann. There are also all the state and local officials Trump will name as defendants in his 2nd RICO lawsuit for the 2020 election steal.
