Whether or not she was raped is irrelevant.
This is Federal Law mandated from whole cloth; there is NOTHING in the US Constitution that hints at Abortion; this decision should, and always should have resided at the State Level.
All rights not given to the Federal Gov't by the Constitution, reside within the purview of the States.
The word Abortion doesn't appear in the constitution, but it is clear that life and liberty is to be protected for all persons and their posterity.
The path you outlined (while I wholeheartedly agree with your premise), assumes that the Liberal will agree that life begins at conception.
Be declaring the right to decide whether Abortion should be a Federal mandate, is solved by the 10th Amendment is very clear.
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
