Any national emergency can suspend the Constitution. Obama passed an EO in 2014.

Trump.invoked it a couple years ago, soft martial law. Biden will invoke his own and he needs an excuse. Because trumps cause of action was over an insurgency and usurpation. This is where I think the military will be forced to act, if the plan worked, and battlefield preparation was successful.
