There was a case in Texas that a guy had hired a farm hand, illegal I think, and caught the POS trying to molest his 6 y/o daughter. He beat the guy to death and the authorities decided not to charge him.
Not sure of the details in the Texas case, but from a legal standpoint, you could have argued the guy lost control. Who wouldn't if they stumbled on something like that? If you lose control, you're not in the frame of mind where you fully know what you're doing so can't be found guilty in the legal system. The authorities probably would have argued that that's what happened from a legal standpoint, and therefore there was no crime.
