"Desantis signed into law today a few new things, one of which is a bill purportedly attempting to legalize capital punishment, i.e. the death penalty against child rapists; with a mandatory life sentence.
While the life sentence portion is legal under current law, the rest is in violation of the 2008 ruling "Kennedy v. Louisiana, 554 U.S. 407" In which the Supreme Court found that "Sentencing a defendant to death for any crime other than homicide or crimes against the state is unconstitutional per se under the Eighth Amendment." -This relates to the application of cruel and unusual punishment.
This is not an argument likely to change, even with a more conservative leaning Supreme Court.
What will likely happen is that its constitutionality will be challenged before it goes into effect in October, and that specific section will be struck down while leaving the mandatory life without parole in effect.
What it DOES* provide however, are political talking points for DeSantis to use in his presidential bid, although that hasn't been announced yet. He is taking pointers from Israeli intelligence behind the scenes, and their connected interests have donated over a **half billion ** to his eventual campaign. As such we can see their general plan in action here is to manufacture conservative based controversy that will give him a specific kind of spotlight. After all, the subject is terribly contentious in that, when the S.C. likely strikes the bill down he can then argue about their intent etc.
It is a perfectly orchestrated move designed to give his people the edge."
