CA bill could have judge's consider race of criminal before sentencing

Bill 852, which passed the California House in May, would require judges to take race into account when they are considering the sentencing of a convicted criminal.

Then why do they need to pass this in CA if it were so? I am in Midwest, no one is given preferential treatment.
