I don't think it's a good idea to restrict stuff like this in the manner they are suggesting. The adsb radio frequency is beamed all around us like wifi signals, satellite, radio etc. Going after people publishing this radio data into a nice consumable form seems like more government restrictions.
If the craft does not want to be seen on "adsb trackers" they simply can turn the radio off in the cockpit.
Civilian craft in most airspaces have to have it on by law to comply with the FAA. Military crafts are exempt but many still use it mearly as a courtesy for ATC as they interact with civilian airspaces and airports (Radar has been largely phased out ATC relies heavily on adsb for aircraft positioning in the skies)
If you had any idea how many "un-trackable" flights occur every day, it would blow your mind.
Most of these apps run solely on transponder signals. One little switch and they become invisible.

That's not their goal, they don't want us spying on them.
When the shit hits the fan they can go dark with no problem.
