This is true to a point. If it is to clear the person was innocent from the evidence and you charged and withheld this evidence. This is why the charge of prosecutorial misconduct exists.
Yes, Brady material needs to be turned over even if the person is guilty. And the prosecution doesn't decide how exculpatory the evidence is.
In general, I think people underestimating these cases and trying to magic wand them away.
Exactly. This follows the same pattern in investigations. How many suspects are cleared because the evidence in the investigation clears them. So as we used to say time to wear out more shoe leather as we have a obligation and duty to bring the correct suspect to trial.
I refused to do the PC from DC by claiming a person of interest. I always referred to them as suspects. I know a lot of interesting people but I do not waste my time with them if it does not pertain to the case.
Some exculpatory evidence may or may not clear a suspect. But your case before going to trial should be strong enough to overcome this. But trials must be fair and all evidence provided to allow a proper defense for the suspect. Otherwise it is no longer a fair trial.
