I wonder if you could sue under the Equal Protection clause. There is some case law precedent I think for the notion that non-citizens have Constitutional rights. I can't remember the context but I know it's out there.
My wife already has a green card and we're applying for an immigration to move back to the states because we'd been out of the country for too long. She should be under the jurisdiction of the US government, and the constitution should apply all the same.
The problem that I've been running into when talking with lawyers is that even if all of that is true, immigration is a section of government that is largely allocated to the executive branch. Biden could say that Chinese people are no longer allowed to enter the country and he would have the authority to do that.
The most frustrating aspect to me is the human rights abuse. The US government is trying to force people to get an experimental medical intervention, that kills 1 in 1,000 of the people who taken and otherwise causes permanent damage for a sickness that might as well not. I'd feel better being outright banned rather than deal with this degree of insult.
