Officers of the court are meant to promote the proper administration of justice. The term most frequently refers to judges, clerks, court personnel, and police officers. Attorneys are also officers of the court and owe the court a duty of candor and obedience to court rules.
This is why lawyers should be forbidden to hold legislative office.
I have asked this question in many fora and of lawyers in person: is it violation of the separation of powers or merely an actionable conflict of interest for a sworn officer of the judicial branch to also serve as a sworn officer of the legislative branch?
Any lawyer who serves in the legislative branch should leave the bar association before taking office and be required to apply for re-admittance after leaving the legislative branch. If this involves re-taking the bar association can then so be it.
