The U.S. Constitution does not explicitly mention a National ID. However, proponents of a National ID often cite the Commerce Clause (Article I, Section 8, Clause 3) as a constitutional basis for its implementation. This clause grants Congress the power to regulate commerce among the states, and it could be argued that a National ID could facilitate interstate commerce by providing a standardized form of identification. However, opponents argue that a National ID could infringe upon the Fourth Amendment's protection against unreasonable searches and seizures, as well as the Tenth Amendment's protection of states' rights.
