Wonder if double jeopardy is the out some of these cabal members are going for?
Could they be banking on not being able to be prosecuted again for the same crimes? I think that they would lose that battle. If I was in their shoes, it's definitely a card I would play even if the only thing that comes from it is stalling the new trial as the issue is sorted out.
Problem is one is a State Crime and the other a Federal. The State and the Feds can charge and their is no double jeopardy. What happens most of the time is the State will dismiss anjd hand it to the Feds to save time and money and clear their Cases.
