At one point Eric Holder moved it to civilian court because of the delays and said it would be faster in civilian court. Then a 9/11 families group protested and they moved it back.
I see no evidence that Gitmo is capable of holding a huge number of tribunals. For years they used tents, then they build a courtroom. A second courtroom was built under the Biden Administration. It just opened in April.
I think people forget that Guantanamo Bay is a naval base and was a naval base before 9/11. There's 8,000 troops there. The prison thing is recent. So a lot of work that goes on there has nothing to do with the prison

The folks above don't fit any of the categories. That's means the military cannot try them. JAGs know this. Civilians facing a military tribunal is very uncommon. Epstein himself was tried in NYC.
Trump talked about making Sayfullo Saipov, the ISIS terrorist face a military tribunal, but it never happened. He was tried in NYC.
Even some enemy combatants never went to Gitmo.
Jose Padilla was designated an enemy combatant held on a military prison in South Carolina for 3 years. Eventually he was tried in a civilian court.
Ali Saleh Kahlah al-Marri was held in South Carolina for 6 years. He eventually was tried in a civilian court.
