I suspect it's being kept around as a looming specter over the heads of the cabal. A measure they know could be pulled forth at any time even while they fight to hold on to what's left.

Either that, it's a warning. Something that can be initiated if the cabal steps over a line. If they do, it could be triggered and they lose the bulk of their authority in the United States. But instead of using it, the white hats are letting the black hats destroy themselves further, which only serves to wake up and embolden the masses even more.
