I think the one in custody is referring to Crooks. You hear him say, "he is dead up there".
Rather than saying he is dead across the radio, they say he is in custody.
I was watching a different video couple days ago. Officers standing on the roof with Crook's body say he is in custody. It is more politically correct than saying his brains are exposed.
