I separated the first OR clause because it means that this is the beginning of a second condition, in that the first condition was met.

The condition after that 'or' is not applicable to this situation. Then the law discusses violations of either of these met conditions.

The way I read this violation, if someone is not harmed, then Fauci et al will get up to a year and/or fined. If someone is harmed by the vax, then Fauci et al could get a fine and/or ten yrs prison; but if someone DIES from getting the vax, then Fauci et al could be imprisoned for life or even put to death.
