Because he killed a mentally ill man who was not a serious threat by chocking him from behind without even trying to talk to the man. He continued choking him for over a minute after the man went limp and people were telling him to "stop, you're killing him!" I live in oakland and take public transit all the time. It's dangerous and all kinds of shit like this happens all the time. But, nobody kills the dude. He went to far and I consider it criminal. If the exact same thing would have happened on our local train system (BART), I likely would have stepped in and physically stopped Penny from killing the victim. And, another thing to point out, since you ask how I can say "he's not a hero," Penny himself said he's not a hero. So, take it from him. But, I'd go farther and call him a killer. He didn't know if the man was having problems from a medication or anything. He had absolutely no concern for the man he killed and has not expressed sny remorse. To put it simply, heis not a hero because he had no respect for the value of another man's life. What would Jesus say about it. Jesus would agree with CurtKobain.
