You're right the construction company most likely hired the illegals, but the Contractee is responsible for the contractor they hire.

The Contractee is responsible for ensuring the contractor they hire is abiding by OSHA regs, etc. so 100% they're responsible for illegals being on site because they knowingly did not do their due dilligence.
