That works, if you want to look at it that way.
IMO, though it may not be popular, any delay caused is more to be seen as self inflicted by the state as a whole. An earned punishment by their indirect actions of allowing the judge to be seated in the first place.
President Trump could bypass it by declaring martial law, but it isnt that dire yet, and the optics would be terrible.
Yes ther is a little random crime going on, but nothing so dire that mass public are in danger. Unfortunately that is just the way it is for now.
