It's likely this would need to ultimately be decided by the SC.
So presumably, KBJ would have to recuse herself, leaving the other 8 justices to decide.
But before it would get there, it would have to go through multiple levels of Federal courts, and also presumably, any Biden autopen appointees along the way would have to recuse themselves (if they aren't already removed from the bench).
I don't think my popcorn supply is sufficient...
