The Math of Her Physical Presence: Under the Immigration and Nationality Act of 1952 rules in effect when Barack Obama was born on August 4, 1961, a U.S. citizen married to a non-citizen (his father was a Kenyan national) had to meet specific criteria to pass on citizenship to a child born outside the United States:
The Law Then: The parent had to be physically present in the U.S. for at least 10 years, at least 5 of which had to be after the age of 14.
Her Age: Ann Dunham was born on November 29, 1942. She was 18 years and 8 months old when she gave birth.
The Shortfall: Because she was only 18, it was mathematically impossible for her to have spent 5 years in the United States after turning 14. She would have needed to be at least 19 years old to meet the standard.
