It's not 1% overall, it's 1% per generation (which is much higher).

Just as a reminder, in 1820, there were 200 capital crimes, including:

Treason

Offences against God

Riot

Destruction of flags and monuments

Perjury

Terrorism

Health Crimes

Smuggling

Murder

Sodomites

Wounding

Rape

Kidnapping

Theft of items worth $10 or more in today's money

Burglary and allied offences

Pickpocketing

Corruption

Bankruptcy
