A small bloc of conservative bomb-throwers is holding the floor of the House of Representatives hostage, forcing GOP leaders to cancel votes for the rest of the week.
For a second straight day, the conservatives blocked several leadership-backed bills from moving forward Wednesday in protest of Speaker Kevin McCarthy’s handling of the debt deal he struck with President Joe Biden.
The brazen revolt means that this hard-right faction, made up mostly of House Freedom Caucus members, has ground legislating on the chamber floor to a screeching halt, undermining the GOP majority and McCarthy’s power.
“House Leadership couldn’t Hold the Line. Now we Hold the Floor,” Rep. Matt Gaetz, R-Fla., a fierce McCarthy critic and one of the ring leaders of the floor revolt, tweeted on Wednesday.
“HOLD THE FLOOR!” Rep. Lauren Boebert, R-Colo., replied to Gaetz in a tweet.
By Wednesday evening, after hours of talks with the hardliners, McCarthy told reporters that no votes would be held for the rest of the week and that the House would come back into session on Monday.
"We're going to have to make up our work next week," the speaker said.
On Tuesday, Gaetz, Boebert and nine other conservatives took the extremely rare step of bucking GOP leadership and teaming with Democrats to vote no on a procedural rule for a slew of GOP messaging bills. The rule failed on the House floor — the first time that had happened since 2002 and a major embarrassment for McCarthy’s leadership team.
Without a successful rule vote, none of the Republican bills can advance.
The conservatives said McCarthy’s debt deal with Biden did not cut enough spending, and they accused GOP leaders of retaliating against conservative Rep. Andrew Clyde, R-Ga., for voting against the rule on the debt package last week.
GOP leaders had hoped to try again Wednesday afternoon to pass the rule governing a suite of bills, including two to protect gas stoves from federal bans. But shortly after noon, the House went into recess, a sign no agreement had been reached between GOP leadership and the far-right rebels who have managed to exploit the GOP's fragile 222-212 majority.
“There’s a lot of conversations but no resolution, so, no point in keeping everybody here,” Scalise said as he left the Capitol Wednesday evening, confirming that there would be no more votes for the rest of the week. “We’re gonna keep working through this. …There’s still some issues we’ve gotta work through within the conference.”
One conservative McCarthy ally, Rep. Thomas Massie, R-Ky., argued that the gang of 11 is needlessly holding up conservative legislation and could, instead, create a path for bipartisan bills to move through the House.
"The floor could keep moving but the only thing that's got a chance of passing is moderate legislation," said Massie, whom McCarthy appointed to the influential Rules Committee. "Their tactic worked because it was a package of conservative bills that no Democrat would cross the aisle for."
Rep. Steve Womack, R-Ark., lashed out at both leadership and the conservatives blocking bills on the floor. He said he had not received "a text or an email" from leadership for hours as he sought an explanation for what was happening with the schedule.
"So you've got the tail wagging the dog," Womack told reporters. "You've got a small group of people who are pissed off, that are keeping the House of Representatives from functioning today, and I think the American people are not going to take too kindly to that."
Moderate Rep. Don Bacon, R-Neb., described the conservative rebels this way: "It's the Dysfunction Caucus."

OK, the penalty needs to be increased. But, there IS a penalty currently, so what can CONGRESS do about it? Just turn it over to the DOJ, who will do nothing?
Nope. There is ANOTHER option.
There are THREE possible methods to penalize someone who has been citied for CoC.
First off, to make a Contempt of Congress CHARGE, it requires only ONE body of the legislature, and by majority rule.
That means the House can issue a Contempt of Congress charge by majority vote, and the Senate has NO SAY in the matter.
Second, if a CoC charge is issued, there are THREE methods to institute punishment. The statute at 2 USC 192 covers only TWO of the methods, and they delegate to the DOJ the authority to handle those two methods: criminal or civil lawsuit.
Of course, the current DOJ will do nothing. But that is alright because there is a THIRD OPTION that the gaslighting RINOs will not be telling you about.
SO WE HAVE TO TELL THEM.
The third option is known as "Congress' Inherent Constitutional Power." Because it is authorized by Congress' Constitutional authority, it falls OUTSIDE of ANY STATUTE (such as 2 USC 192).
IOW: No statute is needed for Congress to implement what the Constitution authorizes it to do.
This "inherent power" has been determined by courts, and was last used in the 1930's.
Here's how it works:
(1) The House (in this case) votes by majority to hold someone (such as Chris Wray) in Contempt of Congress.
(2) Then, the House (and not the Senate) votes by majority to IMPRISON that person. The House then directs its own law enforcer, the Sergeant at Arms (who works for the House, not the Executive Branch), to arrest the person and bring him to the jail on Capitol Hill. There, he is held until he provides the evidence that he is withholding for which he has been held in contempt.
The third, and least exercised, option is referred to as the inherent contempt power of Congress. This isn't found in statutory or constitutional language but rather is inferred by the courts as a function of Congress's legislative powers. The last time this was exercised was in the 1930s, but this was seen more as a way to coerce compliance than as a means of punishment.
The offender, after being cited for contempt of Congress, is tried on the floor of the chamber of Congress invoking the power. If a majority affirms the contempt charge, they may instruct the Sergeant at Arms to arrest the offender and detain them until they comply with the subpoena or until the end of the session. Given the extraordinary nature of congressional detention and its lack of constitutional clarity, it's often seen as a last-ditch -- and unlikely-- effort.
THIS is what we should be pushing on members of Congress.
It's about damn time that they hold SOMEONE RESPONSIBLE FOR VIOLATING THE RULE OF LAW.

Next thing I notice about the tax return is that in 2020, it received $14 million in donations, and in 2021 it was $19 million.
That ain't much for an organization that is having such a MASSIVE impact on wokeness.
In fact, it is a SHOCKLINGLY LOW amount of donations, at least to me.
Also ... VERY interesting ... they ONLY donated a little over $1 million each year, but paid out $10 million and almost $9 million in ... SALARIES and COMPENSATION to the people working for the foundation.
This is VERY ABUSIVE, IMO ... and if they were not politically connected, they would be shut down for running a fraudulent charity. When you pay out to insider salaires almost 10 times the amount of donations paid out, that is a violation of several statutes governing IRS-recognized charities.
Virtually ALL of the rest of their donations were paid out in "other expenses," which I would bet is largely to "consultants" and other pseudo-insiders.
2020 --
$14.3 million in donations received + other income = $15.1 million total revenue
$1.5 million donations paid out (the PURPOSE of a foundation is to give donations) - $10.1 salaries to insiders - $0.2 million "fundraising expenses" - $5.7 million "other expenses" = $2.4 million LOSS for the year
2021 --
$19.1 million in donations received + other income and losses = $19.2 million total revenue
$1.2 donations given (again, this is the PURPOSE of a foundation) - $8.8 salaries to insiders - $0.2 fundraising - $3.7 "other expenses" = $5.4 million profit
Clearly, MOST of the money is NOT going to donations.
So ...
- Not a lot of incoming donations to begin with, considering they are having such a big impact on large corporation
- Not much other income (from investments, which some foundations have, but not this one)
- MOST of the money is NOT going to what the purpose of a foundation is supposed to be
This looks very similar to Black Lives Matter, which was mostly a way to make the insiders rich, and then funnel donations to Act Blue, which gave all their money to Joe Biden and the DNC.
On Page 11, we see that they have a little over $40 million in assets, but those assets do not generate much income (other than maybe some real estate, which is hard to analyze without the Schedule E).
After Page 12, we have a page labeled "Additional Data." This shows that NOBODY in the organization worked full time.
The most is one person who worked 21 hours per week, a few in the 10 or so hours per week, but MOST of the "officers, directors, or key employees" worked just 2-3 hours per WEEK for this foundation.
Even the president, David Alphonso (before he was fired) only worked 4.5 hours per WEEK (busy doing other shady stuff, maybe).

WTF are they REALLY doing?
This is clearly not a full-time operating foundation.
So, why are they having such a big influence?
Looks like it could be some OTHER outsiders are doing the real work, and this is just a front organization.
Down on Schedule I, after Page 2, on "Additional Data" page, we see that of the $1.2 million on donations MADE for 2021, $820,000 of that was to Human Rights Campaign, Inc., which is associated with this foundation, and is used to promote political purposes.
I think this is yet another violation of charity rules. They can do this, but if MOST of their donations are used for this, I think that is a no-go. Though, I am not totally up-to-date on this issue.

- Trump was POTUS during that time, and Eric Trump or the CEO of the Trump Organization would most likely have been handling these invoices and payments, not Donald Trump (although the indictment does not give any detail on that).
- All 34 counts are for violations of New York Penal Law 175.10, "Falsifying Business Records in the First Degree."
- In order to be in the "first degree," there must be a violation of NY Penal Law 175.05, "Falsifying Business Records in the Second Degree," which means it must be (a) false and (b) done with intent to defraud, AND (c) to be in the First Degree, it must have been in order to hide some other crime.

The indictment does not allege any facts that would indicate what "other crime" was being committed or hidden, nor does it allege what "intent to defraud" was.
It looks like a very sloppy, amateurish work on the DA's part. But maybe that's just how sloppy law is practiced in New York. I don't know, but it wouldn't surprise me.
These laws all fall under the general category of fraud. I have heard that these charges are beyond the statute of limitations, which I have heard is 2 years in New York.

It also says misdemeanors are 2 years and "other felonies" (not those listed) are 5 years.
So, 2 years and 5 years are already over. If it is 6 years, then the February and March 2017 charges are already past the statute of limitations.
So ...
They are going to claim that Trump was the head of the Trump Organization in 2017, directing its actions even though he was in the White House, and that the Trump Organization falsely stated what Michael Cohen's invoices were for and what the payments were for and that the ledger entries were falisified to defraud ... who? That is an element that would have to be proven (along with proving that Trump was directing it all).
WHO was defrauded? What evidence is there? Stormy Daniels says there was no affair to cover up. So, the public could not be harmed (not that real American law recognized such a nonsense in the first place). No individuals were harmed, even if it were fraud, and there is no evidence that there was any fraud.
Then, they would have to prove it was all done to cover up some other crime which is NOT alleged in the indictment. That seems like a BIG problem, since if the prosecution does not inform the defendant on what the full extent of the charges are, then it is impossible to defend.
The rumor has been they will allege he was doing it all to hide an affair during a presidential election -- which is federal jurisidiction, not State jurisdiction -- but that is just a RUMOR. It is NOT stated in the indictment (if this document is the real copy of the indictment).
The entire thing looks like a monkey running a kangaroo court.
Would this fly in an American court? Never.
But would it fly in a corrupt New York court? Maybe.
