I‘ve tried to find some info on these 10 days that the DOJ has to wait... any legally adept here that could point me to the according passages in the law?
The DOJ can‘t intervene in an active Election, they have to wait for the final deadline. This is to avoid Election Interference by an investigation of the DOJ.
Well, the Board of elections of North Carolina has extended the deadline for Mail in Ballots to November 12th. The republicans have challenged this decision, but SCOTUS, in a deadlock of 4:4 declined to intervene.
So, although the extension of the Deadline in North Caroline is probably unconstitutional, the nation wide election officially ends just on the 12th of November...
So the DOJ, constitutionally speaking, can act on November 13th at the earliest...
someone i was talking to said that DoJ can't step in on elections until 10 days after the election.
