Pence still has some CYA in his betrayal on the 6th... he can say "I was doing what I thought was right within the bounds of my Constitutional duties."

Actively usurping the Office of the President, however, can't be defended against and if things go bad that's treason. The 25th Amendment is his Rubicon, and I don't think he's got the will to cross it.
