In military commissions, the prosecution must often rely on evidence gathered during military or intelligence operations, in which search intelligence operations, in which search authorizations may not have been appropriate or required. Military commissions evidentiary rules therefore do not require that physical evidence was obtained pursuant to search authorizations."
