So, Enemy Combatants then? Penalty is the same.

Same for Obama, he couldn't technically be charged with treason if he is really a citizen of Kenya, here illegally, but he could be charged as an enemy combatant and spy, yes? And dealt with accordingly. :)

In that case, enemy of state at least, impersonating a citizen, impersonating a president, etc.
