Military court system is separate from SCOTUS. We don't need SCOTUS to rule in favor of the military, for military intervention. Never have. But, the SCOTUS ruling may be needed to initialize military intervention, because the military should ALWAYS be the LAST OPTION. Which is the case here. SCOTUS will "fail" which will finally allow the military to step in.

This analysis you posted is flawed on that point.

I think SCOTUS is needed to rule in favor of it so that the public asks, what do we do now? Military is then justified to take over.
