The petition references that order to establish the clearly defined specifications of the flag, it's not quoting it. The petition continues from the EO to establish that yellow ISN'T in the EO, is a color.

The next reference is 34 ops atty gen 83, and then Ruhstrat vs People, then Title 4 USC sec 1,2 and Title 18 USC sec 242. Not a lawfag, would have to go check these out.
