Thinking of the mic that picked up that voice, what do you imagine that to be? Would Hunter be mic'd and someone accidentally turned that on? Is there a random mic out there somewhere he was sitting next to? I don't really have an opinion on if it's him or not, just helping strengthen this connection, if so. Considering the technical circumstances on how he got recorded is something worthwhile, imo.
I'm leaning more towards someones headset in the (video) control booth either purposefully or accidentally went hot over Biden's life feed.
Instead of a (hard) cut of the persons audio, it's a quick, but gradual fade out.
That leans to the likelihood of someone in the control booth manually doing that.
Whether it was simply an accident, or someone decided to "spill the beans live" when another person faded out their audio before the could finish a statement, who knows?
Ok yeah I was wondering if it could be a studio headset, but I wasn't sure if they were typically wired into the same audio system as the recording equipment.
I could definitely see family being in a studio watching things that way, instead of a wireless mic or something being out elsewhere that was heard.
If a lawyer was in the studio, it could also be a family or personal lawyer and not some rando lawyer.
I definitely see this (the recording coming from an audio/video control studio) as the most likely scenario given a studio headset is wired into the recording board. And yeah I could definitely see that if the studio needs to talk in a studio mix in someone's ear. Good call.
Perhaps a white hat should keep an eye on that audio engineer because they probably know what happened here.

People like me tend to have issues with that if we're not careful. I'd rather think the person on the other end did the recording because they don't have a problem with the way the other person recorded.
Typically in this kind of setup you have multiple mics (wireless, podium, etc.) wired into a soundboard that goes out to a recording / live feed. If someone accidentally bumped (or intentionally moved) the sound board volume fader for a mic input it could mix that sound into a recording.
Another way was it was picked up by Joe's podium mic but I think this is less likely depending on the mic used. I would assume a podium mic wouldn't be broadly omnidirectional which would allow people around it to be picked up and not just the one in front of it. I'm not an audio engineer, but I believe these kind of mics would be pretty focused to avoid picking up stray sounds.
edit: I know belive the most likely source was from an AV studio headset mic, where family/lawyers/ etc were watching.
