Destroying evidence is a crime. But is it enough to get criminal charges?

There have been cases like this involving hackers. White hats want what is in the hard-drive, ect. However, the hacker was smart and encrypted the shit out of it. No way the FBI would get in.

The FBI demanded access, but the hackers weren't stupid... giving them access would give them the evidence they need to convict the hacker of a worse crime. So they simply did not do it as they knew they get a few years versus 20.

I would like to know what the penalty is for destroying "receipts" from the voting machines are.
