I'm not an expert in this area, but my understanding is that an executive order ordinarily goes through a judicial review, and that's partially why there is a 30 day wait on implementation of them. I would be happy if someone corrected me if I am wrong. True we can fight them and overturn them, but to paraphrase Sun Tzu, the easiest battles to win are the ones you don't have to fight in the first place.
Yes, but even beyond that 30 days, someone can go to a judge and get an injunction. Look at DACA, border wall funding, citizenship question on census, and most others.
I'll concede your point. Still would be nice if he conceded (one can hope, can't they?)
