First of all, I am not a lawyer. I am honestly asking for help from the law contingent of our community. I watched most of the impeachment trial, and IMHO, Sen Leahy acted disgracefully. Many people would agree with me on that, but I'm also wondering if he acted illegally. First, he had no right to assume the role of Judge in that particular trial. If Pres. Trump is still a president, then the role of Judge should have been filled by the Chief Justice. The mere fact that Roberts refused to participate should have told the Dems something. If the trial could be overseen by a non-SCCJ, then they must have been trying a NON-President, and the Senate does not have the authority to try a private citizen. So did Leahy commit a crime by facilitating an illegal, unconstitutional trial? Also, during the non-trial, it was clearly demonstrated that the prosecution team had modified evidence. My understanding is that in a normal trial, the judge would have shut them down, right there. By allowing this sham to continue, he didn't do his job as a judge. And then, at the end, he stood up during the role call and voted guilty. As a non-legal person, I am asking: Is any of this behavior illegal or just sickening?

The entire show trial WAS a crime against the Constitution! My question is why are the prosecutors and defense attorneys NOT put under oath? There is only one reason.
The ladies, clerks, ran that trial. If they hadn’t been there to help him on almost EVERY point of order or objection by shoving notes in front of him, explaining what everything was and how to respond we would be in Day 7 of that waste of money! Him and Pedo Joe should share a room at The Sundowners Lodge!
rules... constitution ... they dont follow anything
I wish the public could sue them for abuse of power and wasting our money on a trial that wasn't even technically legal. All of them, they dragged us through uneeded mental anguish as well, they should be punished by having to provide compensation.
I don't think he acted illegally in the sense that the Senate isn't a legal body, but rather a separate body that makes up it's own rules. It would seem that he violated those rules, but it's not like they seem to care.
Both.
I’m not sure about the “legality” of it all but he did a horribly lousy job in that role. Half the time he looked and sounded lost as to what to do next. The whole clown trial would have never flown in a normal court.
I agree that he made a fool of himself, and I'm also wondering whether Pres Trump might not be able to sue him and the House Managers for putting him through all this when they had no legal grounds for doing it. It would be great if he could make them pay his court costs.
fuckin Lahey that drunk bastard
Frigg off Lahey
