I think any defense attorney would very easily defeat that argument. You'd have to prove that she did this on purpose with the express intent of killing them. It would be manslaughter at the most extreme which obviously doesn't have the death penalty as an option.
Not saying I agree with this, just that it's the legal reality. It is EXTREMELY diffi9cult to sentence anyone to death.
