Yes, that is the most likely situation, an alternative reason for SCOTUS inaction could be that, they have been advised by the Patriots to stay well out of the way as these are High Crimes and Treason, which is not within the domain of the civilian legal system, the Military will be taking care of these matters. As we have frequently seen, the civilian legal system is more than broken and incapable of delivering the justice that these crimes require. This may also be applicable to the DOJ and FBI.
