"Has yet to respond" is not equivalent to "refusing to respond".
The captain is an employee, as he is not the owner of the vessel. He won't do anything without being informed so by his employer, and seeing as Egypt is already trying to grift an absurd billion dollars for what amounts to a few days of digging sand, I wouldn't be in a hurry to do anything more than make a talk-to-the-hand motion followed by a thumb-hook to the lawyers.

I saw this article denying her being the captain which, is fine. But, the ship has a captain and that the name of the captain this far into the story has not been disclosed seems odd to me. Francesco Shettino, of Concordia fame is, I am speculating now of course, at least mildly impressed at this captain's ability to remain anonymous.
