HOW are these businesses getting away with REQUIRING their employees to be vaxed? Do they not understand the MASSIVE legal trap they are walking into? Vaccine manufacturers will not pay a penny in liability, but businesses that "force" their employees will see legal battles that will cause the death of small Business America. Just another nail in the economic coffin.
Its important to note the distinction between SAYING "you must get the vaccine" which is likely protected under 1A (not sure about this but guessing) and DISCRIMINATING if you do not get the vaccine.
In other words, they can say anything they want.
If you are aware of the law however, you hold complete power over them (at least until we go full Nazi).
If they ask you if you have been vaccinated you can say yes. If they ask you to show them proof you can say no. They cannot force you to show them, that is a violation of HIPPA. (Take this one with a grain of salt. There are loopholes that I am not 100% sure cannot be applied to this experimental therapy.)
This one I am sure of. If they ask you if you have been vaccinated you can say no. If they say "we will fire you" you can say, "Its a violation of the Nuremberg code to force me to partake in a medical experiment. This vaccine is officially an experimental procedure per the FDA. If you discriminate against me in any way for not participating in this experiment you may be charged with crimes against humanity, just like the Nazi's were for doing the exact same thing. Many of those Nazi's were executed, most of the rest served life in prison." (Some came to work for the US government, but its probably best to not say that part).
The choice is yours. Legally they can do nothing.
Illegally of course they can do whatever the fuck they want, because that's what criminals do. Ostensibly they go to prison for crimes against humanity and you get a big fat civil suit payout. The most likely scenario however, is that any boss (who is just a human) will say "ok" and likely already knows all this.
