While it could still kill someone there is something to be said that a gun that small doesn't tend to induce fear in stupid people as we see the crowd still standing there yelling at him.

If I have to shoot someone I'm shooting to kill. Three rounds of 380 at least. You have to show the court you were in fear for your life.
