I know this is like a meme here... but I am so tired of seeing people try using the HIPAA card. This just tells me they have no idea what the f@#k they are talking about. I am HIPAA certified (take the test yearly) and provide many small doctors with IT services. HIPAA and HiTech compliancy are something I know quite a bit about. If you walk into a business and they ask you for proof of a vaccine this HAS NOTHING TO DO WITH HIPAA. However, if this same company asks your doctor for this status that would be a HIPAA violation for the doctor if they provided it - there would be nothing technically against HIPAA towards that company asking and they would just get a flat "no" from the doctor's office if they are adhering to HIPAA standards. Take that a step further even and say that doctor has an employee that keeps their desktop and EMR logins and passwords on sticky notes on their monitor (this happens ALL THE DAMN TIME) then just the possibility that someone can sit down and access patient medical information (say even vaccination records) is a HUGE HIPAA violation. And don't get me wrong - I just went to a barber as well as to a national chain sandwich shop maskless and wasn't questioned at all about a vaccination. NCSWIC!
Question for you then as you seem well educated on the topic. How does one go about avoiding the “are you vaxxed?” question from their employer? Mine is currently pressing this and I am not sure how to best respond.
This! ☝? I’m in the medical field and we have to take a HIPPA and compliance test every year. HIPPA has to do with people working in the medical field not being able to disclose medical information about their patients or even talk to coworkers (who are also in the medical field) about patients unless it’s a direct need to know. Ex. Nurses doing shift change, doctors collaborating on a patients treatment, etc. HIPPA has nothing to do with some random person asking you specifically anything about your medical history. It might be inappropriate or even an invasion of privacy but HIPPA does not apply outside of the medical field between two citizens not in the medical field.
