The real question is, does the DOJ have the authority (or jurisdiction) to shut down a state election and/or audit?
Bonus round: Does Garland understand how precarious the nation is right now and how close we are to civil disobedience, civil unrest, and even civil war?
He doesn't care. He's one of [them], so a scorched earth policy is definitely in the table in regards to the State audits.
If we accept the fact that Martial Law has been declared, who really knows what laws really apply and what ones don't. We are in a legal gray area that most people don't understand. Myself included.
Yeah, I totally get that. Uncharted territory for sure.
Rights that are not specifically granted to the federal government in the Constitution are the jurisdiction of the states. Fed has no business getting involved.
DOJ doesn't have the authority. Elections are a state thing and DOJ doesn't get to touch it, constitutionally.
That said, he who commands the men with guns makes the rules. If AZ puts the audit under heavy guard the DOJ will be picking a fight they cannot win. AZ can put more armed people in and around the audit site than the fed can without a major mobilization and violation of posse comitatus.
