Gang, I know there is a big downside to the decision, but I'm focusing on the silver lining of a judge saying out loud that Maddow doesn't use facts.
In this case, that conclusion was used to get her off of liability, but at many times in the future that finding will be used to our favor.
It finds that a sensible person would know that the crap she spews is not truth. Legally and officially, only an idiot would believe the things Maddow says.
I definitely agree. A small win will turn into a big win at some point. The seed has been sown.
A finding in this court does not set precedent. Precedent is set in higher courts. This is just noise. But we should never stop repeating it.
The better cause of action would've been to sue under the consumer protection act, saying that maddow and others like her are misrepresenting their "product" to consumers. There is huge money to be made on cases like that and someday a good lawyer will figure it out and run with it.
