Forcing private companies to "mandate" is still considered "voluntary" because you can quit that company (in theory). I don't think full mandates are ever going to stand in the courts due to the EUA.
However, intentionally misleading public regarding health decisions, leading to death of hundreds of thousands - I am sure that would be Crimes against Humanity.
